The Senate Banking Committee reached a consensus on new legislation designed to help homeowners, forestall foreclosures and create more affordable housing in a government-led bail out attempt to save the housing market from imploding on itself. The ranking Republican on the committee Richard Shelby said he’s comfortable that the bill protects American taxpayers from covering for bad bets made by speculators.

I fear that if the complaint in this case is written with anything like the care and clarity of this press release, Downey probably has little to worry about.The Complaint charges that Downey and certain of its officers and directors violated federal securities laws by issuing materially false statements regarding the Company’s financial results. Specifically, the Complaint alleges that defendants concealed the following: (i) Downey’s portfolio of Option ARMs contained millions of dollars worth of impaired and risky securities, many of which were backed by subprime mortgage loans; (ii) prior to the Class Period, Downey had seen Countrywide’s growth and had started to get more aggressive in acquiring loans from brokers such that the loans were extremely risky; (iii) defendants failed to properly account for highly leveraged loans; (iv) Downey had very little real underwriting, which led to large numbers of bad loans; and (v) Downey had not adequately reserved for Option ARM loans, which provided that during the initial term of the loan borrowers could pay only as much as they desired with any underpayment being added to the loan balance.I can’t wait to find out what the evidentiary standard is for (ii).

The Regus Group is relocating its Hauppauge headquarters to a new 13,000-square-foot business center at 150 Motor Parkway.
The new digs feature 58 offices, 120 workstations, two conference rooms and a videoconferencing studio.
Regus, a provider of fully furnished and equipped offices, has eight Long Island locations including one in Bohemia, one in Lake Success, two in Melville, one in Syosset and two in Uniondale.

Fifth Third, the mid-western super-regional bank implemented new FICO requirements for FHA loans originated via its wholesale channel. The new minimum FICO for all FHA loans is now 580. Previously the bank had used “common sense” underwriting with no actual minimum FICO required (although the effective FICO for “make sense” deals was 520).
Other banks have rolled in similar higher-FICO guidelines on their FHA deals of late going from a “common sense” overall file risk assessment to more stringent FICO-driven guidelines.

1) Taos Convention Center Seeking Bidders for Catering and Alcohol Services Contracts
On July 1, the Town of Taos will suspend its liquor license at the Taos Convention Center, opening all alcohol services to any interested businesses or individuals within the Town limits (catering is open to anyone in the area) who can meet current NM Alcohol and Gaming Division and NMED requirements. The Taos Convention Center is currently seeking submission of interest for food service, alcohol service or both for contracts that will begin July 1, 2008. Has the giant and once-red hot California market hit bottom? I am reminded by the words of my former colleague who recently decided to put his house on the market after retiring. I asked if this was the time to sell. He said during the last downturn, in the 1990s, it took eight years for his house to regain its former value. He didn’t want to wait that long.
